Article 1 - Definitions
In these terms and conditions, the following terms are defined as follows:
• Supplementary contract: A contract in which the consumer acquires products, digital content, and/or services related to a distance contract and provided by MyLoveDogToys or a third party based on an agreement between the third party and MyLoveDogToys.
• Reflection period: The period within which the consumer may exercise the right of withdrawal.
• Consumer: A natural person who acts outside their trade, business, craft, or profession.
• Day: A calendar day.
• Digital content: Data produced and delivered in digital form.
• Extended duration transaction: A distance contract involving regular delivery of products and/or services over a specific period.
• Durable medium: Any tool that allows the consumer or MyLoveDogToys to store information for future use in a way that allows unchanged reproduction of the stored data.
• Right of withdrawal: The consumer’s option to dissolve a distance contract during the withdrawal period.
• Distance contract: A contract concluded between MyLoveDogToys and the consumer under a system organized for distance sales, using one or more techniques for distance communication.
• Model withdrawal form: The standardized European withdrawal form included as Annex I.

Article 3 - Applicability
1. These terms and conditions apply to every offer and distance contract between MyLoveDogToys and the consumer.
2. Before the contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not feasible, MyLoveDogToys will ensure the consumer can access the terms electronically or request a free copy.
3. Specific product or service-related terms may apply in addition to these terms. In case of conflict, the most favorable terms for the consumer will apply.
Article 4 - The Offer
1. If an offer has a limited validity or is subject to conditions, this will be explicitly mentioned.
2. Offers will include a clear and detailed description of the products, digital content, and/or services, along with any conditions. Obvious errors or mistakes will not bind MyLoveDogToys.
3. The offer will outline the consumer’s rights and obligations upon acceptance.
Article 5 - The Contract
1. The contract is concluded when the consumer accepts the offer and meets the stipulated conditions.
2. If the offer is accepted electronically, MyLoveDogToys will confirm receipt electronically.
3. MyLoveDogToys ensures secure data transfer for electronic contracts and payments.
4. MyLoveDogToys may decline an order or require additional conditions based on statutory frameworks, provided reasons are given.
Article 6 - Right of Withdrawal
1. For products: Consumers have 14 days from receipt to dissolve the contract without giving reasons.
2. For digital content: Consumers have 14 days from the conclusion of the contract unless performance began with prior consent.
3. If mandatory information about the right of withdrawal is not provided, the withdrawal period extends to 12 months after the original withdrawal period ends.
Article 7 - Consumers’ Obligations in Case of Withdrawal
1. During the reflection period, the consumer must handle the product and packaging with care.
2. The consumer is liable for any diminished value caused by handling the product beyond what is necessary to evaluate it.
Article 8 - Exercising the Right of Withdrawal and Associated Costs
1. Consumers must notify MyLoveDogToys within the withdrawal period using the model form or another clear method.
2. Products should be returned within 14 days of withdrawal notice, in their original condition and packaging if possible.
3. Consumers bear return shipping costs unless otherwise agreed.
Article 9 - MyLoveDogToys’ Obligations in Case of Withdrawal
1. Upon withdrawal, MyLoveDogToys will refund payments, including standard shipping costs, within 14 days of receiving returned items or proof of return.
2. Refunds will use the same payment method unless agreed otherwise.
Article 10 - Precluding the Right of Withdrawal
Withdrawal may be precluded for:
• Custom-made products.
• Perishable goods.
• Sealed items unfit for return for health/hygiene reasons if the seal is broken.
• Digital content delivered with prior consumer consent.
Article 11 - The Price
1. Prices will not change during the validity period of the offer, except for VAT adjustments.
2. Prices include VAT and other applicable taxes.
Article 12 - Compliance and Warranty
1. MyLoveDogToys guarantees that products meet the contract, specifications, and consumer expectations.
2. Additional warranties do not affect statutory rights.
Article 13 - Delivery and Performance
1. Products will be delivered to the address provided by the consumer within the agreed time, with a maximum of 30 days unless otherwise specified.
2. MyLoveDogToys bears the risk of damage or loss until the product is delivered.
Article 14 - Extended Duration Transactions
Consumers can terminate extended contracts with one month’s notice after the initial term.
Article 15 - Payment
1. Payments must be made within 14 days unless otherwise agreed.
2. Advance payments exceeding 50% are not required unless stipulated.
Article 16 - Complaints Procedure
1. Complaints must be submitted promptly and clearly described.
2. MyLoveDogToys will respond to complaints within 14 days.
Article 17 - Applicable Law and Competent Court
Contracts are governed by applicable laws, and disputes will be handled by a competent court.

Any additional provisions must not disadvantage the consumer and should be provided in writing.
